Vipps User Terms and Conditions

Version 1.31 15.11.23

This English version of the Agreement is a translation for your convenience. In case of any discrepancy or conflict between this English version and the current Norwegian version of the Agreement, the Norwegian version shall take precedence.

1. ABOUT THE SERVICE

Vipps is a payment and information service provided by Vipps MobilePay AS (“Vipps” “we” or “us”) and can be downloaded as a mobile phone application. You can find more information about Vipps and how it can be used at www.vipps.no.

2. ENTRY INTO THE AGREEMENT

2.1 The Agreement and Parties


The terms and conditions set out below makes up the agreement (“the Agreement”) between you as a customer and Vipps MobilePay AS, Dronning Eufemiasgate 11, 0150 Oslo, org.no. 918 713 867. In addition to the terms and conditions in the Agreement, relevant prevailing Norwegian statutory provisions also apply.

2.2. What is required to use Vipps?


All the terms below must be fulfilled in order to use Vipps:

  • You must have a Norwegian social security number ("fødselsnummer" or "D-number")
  • You must have an account in a Norwegian bank for receiving payments sent through Vipps. This bank account may also be used for payments ("Source of Funds"), depending on agreements between your bank and Vipps.
  • You must have least one personal debit or credit card issued by a Norwegian bank as source of funds.
  • You must have one personal Norwegian debit card as a recipient card for incoming funds where the payer has used a payment card as the source of funds (“card to card payment”). This debit card may also be used as your source of funds. This is not applicable for users below the age of 15 years.
  • You can link several alternative Sources of Funds to Vipps. You can change the name of your bank accounts registered in Vipps. Name changes will be limited to Vipps.
  • You must have a mobile phone with a Norwegian mobile phone number. Please note; Vipps is based upon open telephone numbers. If you have made a reservation of displaying your telephone number at providers of telephone numbers (i.e. 1881) or you have a secret telephone number (“hemmelig nummer”), your name will still be displayed in Vipps if someone has access to your telephone number, conditional upon you have registered yourself as a Vipps user.
  • Vipps must be downloaded from Play Store or App Store and can be used on mobile phones with iOS and Android (provided Google Play Services are available) operating systems.
  • You must have an e-mail address.
  • You must be over the age of 15 in order to create a user profile. If you are aged between 15 and 18 years, you can only transfer money that is at your disposal. If you are younger than 15 years, your parents can register a Vipps profile controlled by your parents for you.
  • You must have read, understood and accepted this Agreement.
  • Vipps must approve you as a user.

3. USE OF VIPPS

3.1 What Vipps can be used for?

Vipps is a payment solution that enables you to pay in shops, online and in applications containing the Vipps symbol. You can transfer money to clubs, associations and organisations and receive and transfer money from and to other persons. You can see and pay invoices or see and initiate payments of eFaktura by using the Vipps Invoice service.

You can also use Vipps to share information in your Vipps profile with merchants to avoid having to input required information manually, and to be able to login at these merchants (if login is available at merchant).

3.2 Registration, identification and maximum amounts


Before you start using Vipps, you must create a user profile and identify yourself. When registering for the first time, you will have to identify yourself by completing the registration procedure in Vipps. Vipps will verify your identity, for example by automatically checking it against the Norwegian Tax Administration's national register. Are you 18 years or older, you will have to verify your ID with BankID before you can start using Vipps.

Vipps has set weekly and annual maximum amounts for using Vipps. You will find the transaction limits in Vipps and at vipps.no. Vipps has set these maximum amounts to increase security, reduce risk for abuse and protect you as a Vipps user. If you reached your transaction limits, you will not be able to send money in Vipps. Additionally, we have set maximum amounts per payment which might trigger a higher level of security, for instance 3-D Secure requirements.

3.3 Sharing of information from your Vipps profile to merchants

Vipps may, in sign up, log in or payment situations, enable you to share the information registered in your Vipps profile with merchants, for the merchant to register you in their systems; i.e. to deliver the service or product to you. In such situations the merchant will request the information they require, then you can choose whether to consent to this sharing. Vipps will only share the information registered in your Vipps profile with merchants after you have consented to the information being shared. The information requested will be stated in the consent dialogue.

Merchants will be able to request the following personal data:

  • Full name
  • Addresses
  • Email address
  • Mobile phone
  • Date of birth
  • Account number

Only when necessary or based by law:

  • Norwegian social security number ("fødselsnummer" or "D-number")

The merchant becomes an independent data controller of the personal data shared with it. This means that the merchant decides the purpose of the processing and becomes responsible for its subsequent processing of your personal data.

When you have consented to sharing information with a merchant, Vipps will provide the merchant with updated information when you use the merchant’s functionality which gave the merchant your information. Vipps will also store your consent to enable the merchant to get the same information using other Vipps services, without you having to consent for each individual service. This is done since the merchant already has this information. If a merchant asks for additional information, you will be asked for a new consent.

You can see which merchants you have shared information with, and you can withdraw your consent at any time under ‘Settings’ in the Vipps app. If you withdraw your consent you will be asked for a new consent if you would like to use the service at the merchant at a later time. It is important to note that the customer relationship between you and the merchant does not change when you withdraw your consent to sharing information in the Vipps app. This means that your name, address, email address or phone number as requested and given consent for, may be stored by the merchant for its own purposes as an independent data controller.

3.4 Vipps Logg inn

It is easy to sign up or log in with your Vipps profile with merchants that use the functionality ‘Vipps Logg inn’ (Log in with Vipps).

Vipps Logg inn means that you don’t have to enter the information that merchants often require, such as name, address, email address or phone number. Vipps Logg inn also means that you don’t have to think about user names and passwords. Vipps Logg inn enables you to be remembered in the browsers you use, e.g. Internet Explorer, Edge, Google Chrome, Safari or Firefox for easiest possible login.

3.4.1 About the Vipps Logg inn service

When you choose to log in with Vipps Logg inn for the first time, you must always confirm the logon in the Vipps app. If you use Vipps Logg inn on a device (e.g. a tablet or pc) on which you have not installed the Vipps app, you must enter the mobile phone number you use for Vipps. If you choose to be remembered in the browser you are using, you will subsequently be able to sign up and log in with merchants that offer Vipps Logg inn functionality, without having to confirm this in the Vipps app.

If you have already chosen to share information from your Vipps profile with a merchant and you are a registered user in the merchant system, you will be able to log in without giving any new consent. If you have chosen to be remembered in the browsers you use with Vipps Logg inn, you may log in without going through any confirmation processes for this.

3.4.2 Security in connection with Vipps Logg inn

In order to prevent others from gaining access to data about you, it is important that you securely store and keep the devices where you have used Vipps Logg inn. You should also ensure such devices have a screen lock or similar. You should not let other people use or have access to such devices. We recommend that you do not use Vipps Logg inn on shared PCs or mobile devices that other people have access to.

If devices where your Vipps Logg inn are installed are lost or stolen, we recommend that you immediately remove Vipps Logg inn from this device. This is easy to do under ‘Settings’ in the Vipps app from your other device.

Merchants that use Vipps Logg inn are responsible for ensuring that Vipps Logg inn is not used if stricter security requirements are needed to identify the user. It is otherwise up to you to decide whether you want to use Vipps Logg inn for each merchant that offers this functionality, and which devices you wish to use Vipps Logg inn.

3.4.3 Information security and recognition technology in connection with Vipps Logg inn

We use cookies to provide Vipps Logg inn. Vipps Logg inn also use a security solution that retrieves information about your browser to confirm that the cookies have not been copied or changed. Vipps Logg inn will not give anyone access to this information and the cookies will not be transferred to any third parties.

You are deemed to have accepted the use of cookies as long as this functionality is turned on in your browser. If you turn off cookies, the Vipps Logg inn service will not work.

To be able to recognise your devices, we use a cookie with a unique numerical value. The numerical value has been randomly generated, and others cannot deduce your identity from it. We are the only party to have this link to your identity, and this information is protected by the highest data security and access requirements.

Vipps Logg inn will analyse information about your browser to increase security. Such information includes different properties that can be retrieved using standard technology (known as device fingerprinting technology).

Vipps can also register and store other data about your use of Vipps Logg inn to ensure your security and to counteract criminal activity. Such security data can include user behaviour and the condition of the device. These data can only be used to detect deviations from normal values to counteract and, if relevant, follow up criminal activity targeting you and/or the merchant.

3.5 View bank account balance in Vipps

In Vipps, you can easily access account balance information for all bank accounts you have registered as Source of Funds in the Vipps app. You will have access to all account balances available to you under “Account and cards” in the Vipps app. Availability depends upon whether your bank entered an agreement with Vipps. An updated list of all banks who have entered such an agreement with Vipps can be found on our på www.vipps.no.

In order to have access to your bank account information in Vipps, your profile must be verified with BankID and you will have to consent to having your bank account balance information shown in Vipps. You will be able to revoke your consent any time in the app under «profile», «account and cards», «account balance».

3.6 Benefits in Vipps

With Benefits, you can get an overview of your personal memberships and all the benefits you have through selected loyalty programs in the app. Such benefits may include value coupons, discounts, bonus points, special offers, gift cards, credit notes and stamp cards. You can also use Benefits to find and join new benefit programs either through the merchant websites or directly in the app and activate benefits from the app when making a purchase.

When you start using Benefits, you agree that we will use your phone number registered in to look for memberships and benefits in loyalty programs for all the merchants who have an agreement with us (you can see the up-to-date list of all possible merchants on our websites). This lookup will be done every time you visit the Benefits tab in the Vipps app, making sure that the memberships and benefits you see are up-to-date.

The merchant is responsible for data you share with them in context of joining their loyalty program. In the case of joining a new loyalty program without leaving the Vipps app, the Vipps Login service is used. You can read more about this service in Section 3.4.

The merchant determines the terms and conditions for the benefits offered by the merchant. The benefit/membership is solely a matter between the merchant and you and questions, complaints or the like must be directed at the merchant. 

Vipps will only use the membership data necessary to run the service. Other membership data we might receive from the merchant upon doing the lookups will not be stored nor used for any purpose.

You can stop using Benefits at any time in the app. This will not terminate your agreement with the merchant.

4. PRICES

A transaction fee may be incurred for the use of Vipps. Visit www.vipps.no for information on prices under "Questions", "Prices and maximum amounts". If a transaction fee is incurred for a payment order, information about this will appear in Vipps before you confirm the payment.

When you use a credit card as a Source of Funds, costs can be incurred from the use of the credit card if this follows from the agreement between you and the issuer of the card. Vipps does not grant credit related to your use of Vipps.

5. PAYMENT TRANSACTIONS

5.1 Ways you can pay with Vipps


When you have confirmed a payment order transaction in Vipps, you authorise Vipps to carry out the payment on your behalf. You can use Vipps for outgoing payments in the following ways:

  • Payment to private individuals
  • Payments to companies, clubs and associations by searching for the recipient's profile
  • Payments online and in apps where Vipps is one of the payment alternatives
  • Payments in physical stores by establishing a connection with the store's payment terminal
  • Invoice payments

Depending on the amount and previous purchases, you may be asked to implement additional security measures, such as confirmation with BankID, to complete your payments.

5.2 Payment transactions to private individuals


When making payments to private individuals, you can enter the recipient's telephone number or find the name in your list of contacts on your mobile phone. If the recipient (payee) is not a Vipps user, the payment will not be processed. You will be informed in the dialog in the Vipps app if a recipient is not a Vipps user. To continue the payment, the recipient either must register as a Vipps user or you must make the payment through ordinary bank transfer (i.e. NetBank) or other available payment solutions.

When you use Vipps to make a payment transfer to private individuals, you must make sure that the mobile number you enter is correct. When you use Vipps to make a payment transfer to private individuals, your name, telephone number and any message to the recipient is shown in the recipient's Vipps application. Your name will also be shown in the recipient's bank account statements.

5.2.1 Vipps gift functionality

When sending money to other persons, you can choose to send the payment as a gift in the Vipps application. You can personalize your gift payment by selecting your gift wrapping and including a personal greeting which will be shown to the recipient when he or she opens the gift in Vipps. We will send a push-notification to the recipient with information that you sent a gift in Vipps. The gift is opend in the app with confetti animation. Sender and recipient have to be registered Vipps users in order to send gifts in Vipps.

You can choose if you want to send a gift at once, or if you prefer to schedule when the gift should be received for a later date. The maximum time period for scheduling future gift payments is three months. You will always be able to cancel a scheduled gift payment. If you want to change a scheduled payment, you will have to delete the scheduled payment and create a new gift payment.

Sending gift payments in Vipps incurs a transaction fee. Visit www.vipps.no for information on prices under "Questions", "Prices and maximum amounts". Information regarding the incurred transaction fee for a gift payment order, will also appear in Vipps before you confirm the payment. You can always choose to send the payment without gift functionality instead.

Both the amount for the gift payment and the transaction fee will be credited from your payment source on the scheduled payment date. We will send you a push-notification if there should be any problems with your gift payment, to make sure you will be able to re-try

5.3 Vipps to companies, clubs and associations via a profile search


When you use Vipps to make a payment transfer to businesses, clubs, associations or voluntary organisations by finding their profile in Vipps, you must verify that the recipient's profile corresponds to the information you have received from the merchant before confirming the payment. Such information could be the recipient's name, unique ID number and name of the merchant.

When using Vipps in this manner, the recipient will see your name, the payment amount, the last four digits in your mobile phone number and any message you have written. With respect to donations to some charitable organisations, you will be able to give your personal identification number to the recipient so that your gift can be reported by the organisation to the tax authorities to give you a tax deduction if you qualify for such a deduction. Please note that it is the organisation, and not Vipps, which is responsible for reporting your gift to the authorities.

5.4 Vipps online and in apps

When you are going to buy something from an online merchant’s website or in a mobile app, Vipps could be a payment option. If you decide to pay by Vipps, a dialogue in Vipps will specify the amount and recipient, which you must confirm to complete the payment. When you use Vipps in this way, we will convey the amount and any message you write to the recipient along with a transaction ID.

With merchants that offer the possibility, you can choose to share your Vipps profile, see section 3.3 above for more information.

5.5 Vipps recurring payments


Approved online merchants can offer Vipps recurring payments on their webpage or in their mobile app as payment option.

The Source of Funds you chose for the first payment in a recurring payment agreement will be charged by Vipps for all following payments. You will find payment confirmations for all payments connected to a recurring payment agreement in the payment history in your Vipps app. If you want to change Source of Funds used for payments connected to a recurring payments agreement, you can do that in your Vipps app under "my recurring payments".

When you try to delete a Source of Funds used in a recurring payment agreement as funding source, you will get an error message. You will have to replace the Source of Funds you want to delete with an alternative funding source before you can delete it. You will find an overview over all recurring payment agreements you accepted in your Vipps app under "my recurring payments".

Vipps is not responsible for any aspects of entering, changing or terminating your recurring payments agreement between you and a merchant. The merchant will be responsible for to answer all questions and handle all complaints regarding the agreement between you and the merchant. The merchant is also responsible for the delivery and quality of products and services. You will always have to contact the merchant in order to terminate a recurring payments agreement. Vipps is not responsible for lacking payments or failed payments, e.g. because we were not able to charge the Source of Funds registered in a recurring payments agreement.

Vipps will send you a push notification when the Source of Funds registered in a recurring payments agreement expires, to enable you to replace the expired Source of Funds. Vipps will also send push notifcations when recurring payments fail. You are responsible to fulfil your contractual duties regarding the recurring payment agreement you entered with the merchant. Therefore, you are responsible to pay with alternate payment methods. This also applies when you delete your Vipps profile.

5.6 Vipps inStore


Some physical stores are able to send a Vipps online payment request (see chapter 5.4 Vipps online and in apps) from the stores cash system.

5.6.1 Payment with a digital BankAxept card

Vipps makes it possible to pay with a digital BankAxept card at merchants which support this. You may enter this service if your bank (card issuer) facilitate the solution.

The personal data in your Vipps profile (bank account number and social security number) will be shared with your bank (card issuer) to request if there is a valid BankAxept card to be digitalized.

The payment with a digitalized BankAxept card will be available at merchants which provide an QR-code. When you scan the QR-code, you will be presented to an amount and the name of the merchant. If you confirm the payment by press “Pay”, the payment will be initiated if the payment is confirmed by the payment system in the terminal.

The confirmation (receipt) will be presented in your Vipps app.

Terms and conditions for using BankAxept as a card holder follow the standard terms and conditions in your ordinary agreement with your bank.

5.7 eFaktura in Vipps

5.7.1 About "Always eFaktura"

Vipps is part of the banks' common solution for digital invoices, known as eFaktura. With eFaktura you can easily receive invoices digitally in all payment interfaces that offer e-invoices and from all e-invoice issuers you have purchases from. The solution is the same as in online banking.

5.7.2 About the Service

  • You can consent to "always eFaktura" in the app under "Invoices and eFaktura". By activating "always eFaktura", you agree that all invoice issuers can send you invoices digitally, for processing in Vipps and in your online and mobile bank.
  • You can unsubscribe from eFaktura for all digital payment surfaces. You can also do this under "Invoices and eFaktura" in Vipps. If you turn off eFaktura, you will no longer receive bills electronically, neither in Vipps, nor in your online and mobile bank. In this case, invoice issuers will need to send you invoices in another way, such as email or post.
  • If you activate "View eFaktura in Vipps" under "Invoices and eFaktura", invoices will automatically be available for viewing and processing in Vipps. You can easily turn this on and off, and it will only change whether invoices appear in Vipps or not.
  • You choose whether you want to process bills in Vipps or in your online bank, but in both cases, it is your bank account that will be charged on the specified payment date in accordance with information in the online bank. Your online banking and Vipps are synchronized, so there are no risk of paying double.
  • If your bank does not support payment of e-invoices in Vipps, you will still be able to see your bills in the app, but not pay them.

5.7.3 Reservation and changes in payment details on eFaktura

  • In your online bank, you can reserve yourself against receiving e-invoices from specific invoice issuers.
  • You can change the payment amount and date in Vipps before the invoice is sent for payment.
  • If you wish to change your payment details after you have confirmed your invoice in Vipps, you must do this in your online bank.

5.7.4 Content and processing of e-invoices

  • Vipps is not responsible for the content of e-invoices and underlying payment requirements. Vipps does not have any influence on which person the invoice issuer believes is the addressee of the payment claim.
  • An e-invoice processed in online banking will no longer be possible to pay in Vipps. If you delete an e-invoice in an online bank, it will also disappear in Vipps. Invoices can also be follow-up of outstanding receivables, including debt collection notices and payment requests.

5.8 Vipps Bill Scanner


You can also use Vipps to pay invoices you have received in paper format or by e-mail. You do this by clicking on "Scan" in the main menu and take a picture of the invoice. It is not necessary to take a picture of the entire invoice, the most important thing is that the photo contains all payment details, such as account number, KID number, amount, and due date.

These images are stored by Vipps so that, if necessary, you can find and see the picture of the invoice after the payment has been made. You should not take photos of anything that does not contain payment details. Such images may be deleted without notice and may be interpreted as misuse of the Service.

Vipps analyses the image, identifies payment details and returns these in the form of pre-filled values. You can choose whether you want to use the suggested payment details or if you want to overwrite them manually.

You are responsible for checking that complete and correct payment details are used for every payment, even where Vipps suggests this when filling in pre-fill. When paying, you can choose between the bank accounts you have registered in Vipps as a payment source.By confirming the payment, you authorize Vipps to carry out coverage checks, reservations, and charges of the selected payment source. It is not possible to revoke the payment order after you have confirmed it and the payment has been initiated in Vipps.

5.9 Vipps online via PSP


Vipps offers two different payment solutions regarding online payments:

  • For merchants using Vipps direct integration (as described under 5.4), Vipps will process your online payments, i.e. Vipps is responsible for charging your payment card, clearing and settlement.
  • For merchants using Payment Service Provider (PSP) integrations, the payment will be initiated in your Vipps app. However, the merchant's PSP and card acquirer will be responsible for processing the card payments and Vipps is not involved in this process

Whenever you chose to initiate online payments in Vipps via a PSP, Vipps will send a card token to Nets. Nets will "decode" the token and send the necessary payment card data to the merchant's PSP and acquirer, so the payment can be processed. Forwarding the token to Nets is a necessary step in order to enable the payment processing. Vipps is not forwarding any information to the merchant directly. The merchant's PSP/card acquirer will hereafter authorise the payment and charge the payment card you chose in Vipps.

5.10 Vipps “Cover for me”

If you have a challenge with paying one of your invoices before its due date, you may consider using the “Cover for me” service in Vipps. This service is provided by Sparebank1 Kreditt AS. SpareBank 1 Kreditt AS pays your invoice on your behalf and issues a new invoice to you with a delayed due date (30 days).

This is how the “Cover for me” service works:

  1. If using the service for the first time, you will have to provide information about your personal finances. This is a necessary step to enable SpareBank 1 Kreditt AS to decide if they can lend money to you. In this review, a credit check of you is also conducted.
  2. When you are finished registering the necessary information, you will have to accept the terms and conditions for Vipps “Cover for me” with BankID. Thereafter, SpareBank 1 Kreditt AS will pay your invoice within the next banking day.
  3. Some days later, you will receive a new invoice (eInvoice) issued by SpareBank 1 Kreditt AS. This eInvoice will be available in Vipps, but also in your bank’s internet and mobile banking solutions. The new invoice will have a new, delayed due date and the amount will now include the service fees for Vipps “Cover for me”.
  4. When SpareBank 1 Kreditt AS is lending you money, they have to report the amount you owe them to the national debt register.
  5. SpareBank 1 Kreditt AS will register the new invoice’s amount as your new credit limit with them after you paid back the sum you owed them. This means that you can use this credit limit the next time you need some extra days for paying an invoice, without having to go through the application process again. However, if the amount of your next invoice exceeds your credit limit, you will need to go through all steps of the credit application process again.

You can use the “Cover for me” service in Vipps for all invoices you received in Vipps, as well as for invoices you scanned by using the Vipps invoice scanner, provided the invoices was issued with a KID-number. The service cannot be used for invoice amounts lower than 500 NOK and higher than 10.000 NOK. Furthermore, it is not allowed to use the service to lend money for paying invoices from other credit companies including credit card issuers, debt collectors, fines, child support, etc.

Provided that you outright pay the invoice from SpareBank 1 Kreditt AS within its due date, you will not be charged any interest. If you choose to only pay the minimum amount or any other amount between the minimum amount and the complete invoice amount, SpareBank 1 Kreditt AS will charge you with interests according to their terms and conditions. If your payment is delayed or you pay less than the minimum amount specified, interests and fees according to the agreement will be charged.

5.11 Vipps Checkout

Vipps Checkout lets you pay with Vipps or cards. Vipps Checkout lets you be remembered on your devices, through storage of your name, phone number, email address, address and delivery address per device, if you opt in.

5.11.1 Information security and recognition technology in connection with Vipps Checkout

We use cookies to provide Vipps Checkout. To be able to recognise your devices, we use a cookie with a unique numerical value. The numerical value has been randomly generated, and others cannot deduce your identity from it. We are the only party to have this link to your identity, and this information is protected by high data security and access requirements.

5.12 Incoming payments and payment requests


You can receive payments from others in Vipps. You will receive incoming payments from others in Vipps either to your recipient account or your recipient card depending on what payment instrument the payer has chosen. Users below the age of 15 will always receive funds on their recipient account. You can also use Vipps to request payment from another person who uses Vipps. You can only do so if you have a contractual basis for the payment request with the person you are sending the request to. If you misuse the opportunity to send payment requests, it will be regarded as a serious breach of the Agreement and entitle Vipps to terminate your access to Vipps.

5.13 Rejection of payments


If statutory or contractual terms for effecting payments have not been fulfilled, Vipps may reject the payment. For example, Vipps will reject the payment if there are insufficient funds in the Source of Funds and if the bank suspects misuse, fraud or money laundering or attempts thereof. It is not permitted to use Vipps as payment for stakes related to participation in betting games, wagers or other forms of gambling which are illegal in Norway. If such use is suspected, the payment will be rejected. Any actual or suspected misuse as described in this provision can be regarded as a serious breach of the Agreement and entitle Vipps to terminate your access to Vipps and revoke this Agreement, cf. item 6.5. If the purpose is legitimate, you will be informed that the payment has been rejected and what you can do to rectify the situation so that the payment can be affected.

5.14 Reimbursement


If you use Vipps to pay for goods or services, but subsequently agree with the seller that you are entitled to a refund, or if the purchase is annulled for any other reason, the amount will be paid into the Source of Funding used for the payment that is to be reimbursed.

5.15 Errors in payment transactions

Once you have confirmed an outgoing payment in Vipps, the payment is final and cannot be reversed. If, in your opinion, a payment has not been approved by you, you must use the right to complain as described in item 5.15. If you have received a Vipps payment which is due to an error on the part of Vipps, Vipps can rectify the error by debiting your Source of Funds by the end of the third working day after the error was made. Moreover, erroneous crediting or debiting of an account on the part of Vipps is regulated by the stipulations in Sections 4-25 and 4-28 of the Financial Contracts Act.

5.16 Vipps' liability in connection with payment orders, the purchase of goods and services and invoice payments

Vipps shall effectuate payments in accordance with your instructions in Vipps. If Vipps makes a mistake in connection with the payment, Vipps shall rectify the error and cover your loss, subject to the limitations in Sections 3-49, 3-50, 4-28, 4-29 and 4-33 of the Financial Contracts Act. Vipps cannot be held liable for losses that are due to circumstances beyond Vipps' control which it could not reasonably be expected to have foreseen or avoided the consequences of, cf. item 9.3. Erroneous or delayed payment transfers due to failures in the telecommunications network or unforeseen failures in other systems that are delivered by third parties and are necessary for Vipps to function, will always be regarded as such circumstances.

Vipps is also liable for losses arising when payments have not been approved by you, provided that the terms and conditions are fulfilled in accordance with Section 4-30 of the Financial Contracts Act.

Vipps is not liable for errors made by you when you have entered a payment order in Vipps, see Chapter 6 of this Agreement. For example, Vipps is not liable if the recipient, telephone number or amount etc. is incorrect. Vipps is not liable for the content of the Vipps invoice and the demand for payment. Nor does Vipps have any influence on which person the invoice issuer regards as the addressee of the claim.

If you think that Vipps is liable for errors in connection with a payment, you must contact Vipps and issue a complaint in accordance with item 5.17. If you think there is an error in an invoice you have received in Vipps Invoice, you must take direct contact with the issuer of the invoice.

Once you have made a payment in Vipps, Vipps will send you a confirmation of the payment in an e-mail and in Vipps. If you have purchased a product or service with Vipps, the seller is responsible for giving you a receipt for the purchase. Vipps' confirmation of the payment in Vipps is not a receipt for the purchase.

When you buy goods or services, the seller is liable for any errors and defects. Vipps is not liable for this.

5.17 Complaints and reversal of payments


If, in your opinion, Vipps has carried out a transaction you have not approved (authorised), you must issue a complaint to Vipps. The rules for such complaints are set out in the Financial Contracts Act Sections 4-23, 4-24, and Sections 4-30 – 4-32. These rules can be summarized as follows:

  • You are obliged to protect your code that provides access to Vipps. If you become aware of others having access to making payments or other use you haven’t approved, you must inform us as soon as possible, and no later than 13 months after the debit date.
  • If you make a complaint because you mean that you haven’t approved the payment and require your funds returned, Vipps shall execute this within the next business day. This is not applicable if you confirm being responsible for the payment in writing, or if Vipps has reasons to suspect fraud and bring the case before the Norwegian Banking Complaints Board or the public courts within 4 weeks after your complaint.
  • We must document that the payment has been approved, correctly registered, and booked, and not affected by any technical failure or other error.
  • You may have to cover parts of your loss, even if you haven’t approved the payment. You will normally be held liable for NOK 450 if your PIN code or other personal security device has been used in Vipps. The amount may increase to NOK 12 000 if you have acted with gross negligence.
  • If you have acted with intent, you will have to cover the full loss. This is also the case if you intentionally have omitted to protect your PIN code or other personal security device that provides access to Vipps.

If a payment is reversed in accordance with this provision, Vipps may nevertheless require that the money be repaid on a later date if Vipps can render probable that the payment was approved by you.

You are not liable for any losses arising after Vipps is informed and your Vipps profile is blocked. You are neither liable for losses that arise if you haven’t been able to block your Vipps profile as result of circumstances with Vipps.

If you suspect that you may have been exposed to a criminal act in connection with a transaction, Vipps can require that you report the matter to the police.

6. YOUR RESPONSIBILITIES

6.1 Correct information


You are responsible for ensuring that the information you provide about yourself to Vipps is complete, correct and updated. If there are any changes in your data, you are responsible for correcting the information in Vipps. You are responsible for providing your correct name, e-mail address, telephone number, card number and account number. This will not be checked by Vipps.

When you use Vipps to make a payment to private individuals, you must make sure that the mobile number you use is correct, as described in item 5.1 When you use Vipps to make a payment transfer to businesses, clubs, associations or voluntary organisations, you must verify that the recipient's profile corresponds to the information you have received from the merchant, cf. item 5.1.

6.2 Personal code - PIN

As part of the registration procedure for Vipps, see item 3.2, you must select a personal code ("PIN"). Your PIN code must consist of four digits and must be different from your other PIN codes, such as the PIN code used for your Source of Funds or your mobile phone. Vipps is free to refuse the use of certain PIN code digit combinations.

The Vipps service is for personal use only, and you must not disclose your PIN code to any third party. You are responsible for ensuring that others do not gain access to your Vipps application. Under no circumstances must you give your PIN code or other security procedures to anyone, including Vipps. If any third party asks you to disclose information that can be used to access Vipps, this must be regarded as attempted fraud. Thus, you must refuse to share such information and inform Vipps without undue delay. You are responsible for informing the relevant bank or financial institution your Source of Funds in Vipps is linked to.

6.3 Lost or stolen mobile phone


If your mobile phone is stolen or lost, or if you suspect unauthorised use of Vipps, you must notify Vipps as soon as possible. When such notification has been given, Vipps will block the use of Vipps until further notice.

6.4 Legitimate use


You cannot use Vipps in breach of prevailing Norwegian law or in violation of this Agreement. If you are to use Vipps for business purposes or to receive payments on behalf of your club, association or organisation, you must enter into a separate agreement governing this with Vipps. The use of Vipps with a personal profile for business purposes is deemed to represent a serious breach of the Agreement and will result in your Vipps profile being blocked.

If you use Vipps in a way that entails a risk of money laundering, for example by buying or selling Bitcoins, or in a way that other Vipps users perceive to be offensive or insulting, for example if you send inappropriate messages to other users, Vipps may block your Vipps profile. You cannot use Vipps on a mobile phone which is jailbroken/rooted. The use of Vipps on a phone which is modified in this way creates a risk for the misuse of Vipps and compromises the information entered in the app. Vipps will therefore consider the use of Vipps on a device which is jailbroken/rooted as a serious breach of the terms and conditions for the use of Vipps as a means of payment, which is of consequence to your responsibility as a customer in the event of misuse caused by this.

6.5 Consequences of illegitimate use

If Vipps has reasonable grounds to believe that your use of Vipps is in violation of law or this Agreement, Vipps is entitled to temporarily stop your use of Vipps. If such use is not discontinued or represents a serious breach of the Agreement, Vipps is entitled to terminate the Agreement. Vipps is under no obligation to inform you before the Agreement is terminated but will seek to give such notice and to provide you with the opportunity to rectify the matter if this is possible.

6.6 Misuse of Vipps


You will be liable for up to NOK 450 in connection with losses resulting from unauthorised payments due to the use of a lost or stolen payment instrument provided that your personal security procedure has been used. The same applies to payment transactions carried out following unauthorised appropriation of a payment instrument if you have failed to protect the above-mentioned personal security procedure and this has been used.

You will be liable for up to NOK 12 000 in connection with unauthorised payment transactions if the loss is due to the fact that you, through gross negligence, have failed to fulfil one or more of your obligations under this Agreement. If the loss is due to the fact that you, through gross negligence or with intent, have failed to meet the obligations under this Agreement, you shall cover the entire loss. The same applies if the loss is due to the fact that you have acted dishonestly.

Your liability under this item may be modified in accordance with the rules in Section 4-31 of the Financial Contracts Act in cases where Vipps fails to meet sound standards and the unauthorised use is related to this.

You will not be liable for losses which occur after Vipps has been notified and your Vipps profile has been blocked. Nor will you be liable for losses if you have had no opportunity to block your Vipps profile due to circumstances at Vipps.

6.7 Vipps' customer due diligence - consequences


In accordance with the money laundering regulations, Vipps has a duty to apply customer due diligence measures when establishing customer relationships and in the ongoing monitoring of existing customer relationships. This may include investigations concerning the use of Vipps. If required by Vipps, you must provide information about your or others' use of Vipps or give Vipps other information. If you fail to give Vipps the required information in connection with Vipps' customer due diligence procedures, or if satisfactory customer due diligence cannot be implemented for other reasons, Vipps may terminate the Agreement with immediate effect.

7. ELECTRONIC COMMUNICATION

By entering into this Agreement, you consent that the Agreement is entered into electronically and that this also applies to amendments to the Agreement. You accept that Vipps will communicate with you directly in Vipps, to the telephone number you have stated in Vipps, or by using your stated e-mail address.

8. VIPPS PRIVACY POLICY

In order to enable you to use Vipps, Vipps needs to receive, use and store some of your personal data. Most of these data are provided by yourself in Vipps when you register and are generated when you use the service. Vipps has a separate Privacy Policy which you will find under "Personvern og vilkår" in the Vipps menu.

9. GENERAL PROVISIONS

9.1 Duration and termination

The Agreement remains in force as long as Vipps offers Vipps. Vipps can choose to no longer provide Vipps subject to two months' notice. If you have breached the Agreement, Vipps can terminate the Agreement with you without prior notice.

If you wish to terminate the Agreement, this can be done by contacting Vipps as described under item 9 below. Please note that the Agreement will remain in force even if you delete Vipps from your mobile device. If you do not use Vipps over a period of six months, Vipps can choose to deactivate your Vipps profile.

9.2 Amendments to the Agreement


Vipps can make amendments to the Agreement without prior notice. The prevailing terms and conditions of the Agreement will be available in Vipps and at www.vipps.no. Amendments which are not in your favor may only be implemented by Vipps subject to two months' notice. If you do not wish to accept amendments to the Agreement, you must terminate the Agreement and your use of Vipps. If you continue to use Vipps after the Agreement has been amended, the amendments are deemed to be approved by you. Amendments to the registration procedures to comply with regulatory and security requirements, or to prevent unlawful activity, can be implemented by Vipps without prior notice.

You can contact Vipps at any time and ask to receive these terms and conditions in a paper version.

9.3 Temporary suspension of the Agreement


Vipps' obligations under this Agreement - including the duty to make payments and debits - shall temporarily cease to apply if circumstances arise which are beyond Vipps' control, which Vipps could not reasonably be expected to have foreseen or avoided the consequences of and which render impossible completion of the Agreement. The same applies to circumstances which are due to Vipps' statutory obligations or pursuant to law.

Whatever your request, you can contact Vipps for assistance and information at: www.vipps.no, or by calling +47 22 48 28 00. Call +47 22 48 28 00 to report loss of your mobile phone or to block the Vipps service.

9.5 Dispute resolution


This Agreement is governed by Norwegian law. In the event of a dispute where you disagree with Vipps and we do not resolve the matter to your satisfaction, you can submit the matter to the Norwegian Financial Services Complaints Board. The Norwegian Financial Services Complaints Board can be contacted via klageskjema.finkn.no or to the Board's secretariat at postal address: P.O. Box 53 Skøyen, N-0212 Oslo.

9.6 Concessions and supervision


Vipps MobilePay AS has a licence as an e-money institution and is subject to supervision by Finanstilsynet (the Financial Supervisory Authority of Norway), P.O. Box 1187 Sentrum, N-0107 Oslo and the Norwegian Data Protection Authority, P.O. Box 8177 Dep., N-0134 Oslo.

SPECIAL TERMS AND CONDITIONS FOR THE SERVICE VIPPS U15

These terms and conditions apply in addition to the general terms for Vipps for private individuals. The service can only be used by Vipps users under the age of 15 and it is linked to parents' Vipps profiles. When a child turns 15, they can create a Vipps profile without their parents' consent, by deleting the child profile and creating a new Vipps profile. Vipps has not defined a lower age limit, and it is up to parents themselves to decide when their child can start using Vipps U15.

1.ABOUT THE SERVICE


Vipps U15 is a payment service delivered by Vipps, which is based on parental consent. This means that parents must add the child in their Vipps app, before the child can create their own profile. We confirm your parental responsibility for the child by obtaining information from the National Population Register. The other parent will be notified that we are creating a profile for your child. Vipps U15 enables children to receive money, ask for money and transfer money to other people. Both parents must give their consent before the child can transfer money to other private individuals.

2.FORMATION OF CONTRACT


All the conditions below must be met before your child can use Vipps U15:

  • Both parents must have an active Vipps profile that is verified by BankID.
  • The child must have a Norwegian personal ID number or D number.
  • A Norwegian bank account must be given for incoming payments. The child must be registered as the account holder. Vipps checks the account ownership and verifies the connection between the child and the payment account in the banks' joint account and address register (KAR). This bank account is also used for outgoing payments, on the condition that both parents have consented to this by activating the function that gives the child the right to send money using the Vipps U15 app. The bank accounts that can be registered and used by Vipps U15 depend on the contractual relationship between Vipps and the bank where the account is registered. You will find a list of the banks that can be used at vipps.no.
  • The child must have a mobile phone with a Norwegian phone number. The service does not support the use of unlisted numbers. If the child has an unlisted number, they will not be able to use Vipps U15.
  • Vipps U15 must be downloaded from Play Store or App Store and can be used on mobile phones with iOS and Android (provided Google Play Services are available) operating systems.
  • Vipps must approve the child as a Vipps U15 user.


3.USING VIPPS U15

3.1 When you can use Vipps U15


Vipps U15 is a simplified version of Vipps. Children can receive money, ask for money and transfer money to other people. A child can send money to others if both parents have approved this in their Vipps settings. Children cannot send chat messages in Vipps U15, but they can receive messages from other Vipps users.

Children can also send and receive chat messages from other Vipps users in Vipps U15. Both parents have access to all messages which were sent or received in their child’s Vipps profile in their Vipps application. The payment history is available via the bank account registered in the U15 profile.

3.2 Registration, identification and maximum amounts


Before your child can start using Vipps, you have to add them to your own Vipps profile. You do this by going to 'Profile' and selecting 'Add a child. You must consent to us obtaining information about you and your children from the National Population Register. Vipps obtains information about parental responsibility from the National Population Register, but has limited access to information about changes in parental responsibility. In certain cases, Vipps does not support the creation of a child's profile.

You select which of your children under 15 you wish to create a Vipps U15 profile for. When you create a child's profile, we are obliged to inform both parents. You must therefore consent to us notifying the other parent before we can complete the registration. The child will receive an activation code from Vipps after you have registered their mobile phone number and bank account number.

When the child has been registered and is ready to use Vipps U15, it is up to you as parents to consent to the child being able to send money to other private individuals. Consent is given under 'Profile' in the parents' Vipps apps. Select your child and activate the consent. The child can only send money to others when both parents have registered their consent. You can see all the payments made and received in the child's bank account in your online bank.
Vipps has stipulated maximum amounts. The maximum amounts that apply at all times are available at www.vipps.no. The maximum amounts have been set to increase security, reduce the risk of crime and misuse, and to protect the child as a Vipps user. If the maximum amounts are reached, the child will not be able to receive or money. Money that has been sent to the child will be refunded to the sender within three days of the money being sent.

3.3 View bank account balance in Vipps U15


Children can easily access account balance information for bank accounts registered as Source of Funds in the Vipps app. Account balance information can be found on the home screen in the child’s Vipps app. Availability depends upon whether your bank entered an agreement with Vipps. An updated list of all banks who have entered such an agreement with Vipps can be found on our www.vipps.no.

In order to give your child access to bank account information in Vipps, you will have to consent to having the bank account balance information shown in Vipps. You will be able to revoke your consent any time in the app under «profile», the child’s name, and «account balance».

4.PRICES


Using Vipps U15 may incur a transaction fee. Information about prices is available at www.vipps.no under Questions, Prices and maximum amounts. If a transaction fee is incurred for a payment order, you will see information about this in Vipps before you confirm the payment.

5.PAYMENT ORDERS

5.1 Incoming payments and payment requests


The child can receive payments from others in Vipps U15. The child can also use Vipps to request payment from another private individual who uses Vipps. The child can only do this if they have a contractual basis for sending payment requests with the person they are sent to. Misuse of the right to send payment requests will be deemed a material breach of contract, giving Vipps the right to terminate the child's access to Vipps U15.

5.2 Payment orders to private individuals


For payment orders to private individuals in Vipps U15, the child searches for the recipient's phone number or name in their contact list. If the recipient is not a Vipps user, the payment order will not be processed. In order to receive a Vipps payment, the recipient must be a registered Vipps user.


When the child uses Vipps U15 to pay private individuals, they must check that the recipient's mobile phone number is correct. When the child uses Vipps to pay a private individual, the child's name and phone number will be shown in the recipient's Vipps app. The child's name and account number (Source of Funds), will also appear in the recipient's transaction history in online banks and bank statements.

6.THE CHILD'S RESPONSIBILITIES

6.1 Personal code - PIN


In connection with the registration procedure in Vipps, cf. section 3.2 of the Special terms and conditions for the service Vipps U15, the child must select a personal code (PIN). The PIN code comprises four digits and must be different from other PIN codes used by the child, such as the PIN code for the child's mobile phone. Vipps is entitled to deny the use of certain digit combinations as PIN codes. If child needs to reset PIN-code, parent need to call our customer center.


Vipps is a service that is exclusively for personal use, and the child must not give others access to the Vipps U15 app or disclose their PIN code to others. You must ensure that others do not gain access to the child's Vipps app. The child must not under any circumstances disclose their PIN code or other security information to anyone, including the police, the bank or Vipps. If any unauthorised persons ask the child to disclose information that can be used to gain access to Vipps, the child must refuse to do so. Such and similar attempts to gain unlawful access to PIN codes or other security procedures must be reported, either by the child or you, immediately to Vipps. It is your responsibility to notify the bank or financial undertaking which the child's Source of Funds in Vipps is linked to.

6.2 If the child's mobile phone is lost or stolen


If the child's mobile phone is stolen, lost or you suspect unauthorised use of Vipps U15, you or the child must notify Vipps as soon as possible. When you have notified Vipps, it will block Vipps U15 until further notice.

6.3 Misuse of Vipps U15


In an assessment of whether a Vipps U15 user can be held liable for unauthorised payments and, if applicable, when determining the amount of liability in damages, the child's age, development, behavior, their ability to pay and any other circumstances will be taken into account, cf. the principles in the Compensatory Damages Act Section 1-1.

  • Reduced liability for minors under 13: The U15 user is liable for up to NOK 800 for losses in connection with unauthorised payment transactions due to the user intentionally not meeting the obligation under section 6.1 of the Special terms and conditions for the service Vipps U15 if the user should have understood that the intentional act would entail misuse of Vipps. The same applies in the event of fraudulent conduct on the part of the user.
  • Reduced liability for minors over 13: The U15 user is liable for up to NOK 1,200 in connection with unauthorised payment transactions if the loss is due to gross negligence on the part of the user in that they have failed to comply with one or more of their obligations under this Agreement. If the loss is due to intent on the part of the user in that they have failed to comply with the obligations under this Agreement, the user must bear the entire loss. The same applies if the loss is due to fraudulent conduct on the part of the user.

The user's liability under this section can be reduced pursuant to the rules in Section 4-31 of the Financial Contracts Act in the event that Vipps fails to meet sound standards and the unauthorised use is related to this.

7.PARENTS' LIABILITY


Where the Agreement describes that a Vipps user can incur liability in damages, for example for the misuse of the account by others, the parents may also incur joint liability pursuant to the Compensatory Damages Act in the following cases:

a) Pursuant to the Compensatory Damages Act Section 1-2 no 1, parents are obliged to pay damages for damage inflicted by children and youth under 18, to the extent they have failed to provide due supervision or have not done what can reasonably be expected of them to prevent damage.

b) Pursuant to the Compensatory Damages Act Section 1-2 no 2, parents are liable, irrespective of whether they are at fault, for up to NOK 5,000 per loss event as a result of minors' tortuous acts.

Parents may also incur liability in damages in relation to Vipps if they, acting as a guardian and/or manager, carry out transactions on the account in breach of this Agreement or of the provisions of the Guardianship Act, and this leads to a loss for Vipps.
